Welcome to Testees. These Terms of Service ("Terms") govern your access to and use of the Testees platform, website, and related services (collectively, the "Service"), which are owned and operated by Gumptious Enterprises, LLC, a Delaware limited liability company ("Company," "we," "us," or "our").
By accessing or using the Service, you ("User" or "you") agree to be legally bound by these Terms. If you do not agree to these Terms, you may not use the Service.
Testees is an autonomous, artificial intelligence-driven software-as-a-service (SaaS) platform designed for web application testing, discovery, and regression monitoring. The Service utilizes experimental generative AI technologies (including LLMs) to interpret web interfaces, generate test sequences, and execute simulated user actions.
Acknowledgment of AI Limitations:You explicitly acknowledge that the Service relies on probabilistic AI models. The Service may produce inaccurate, incomplete, or unintended results (often referred to as "hallucinations"). The Company makes no representations or warranties regarding the accuracy, completeness, or reliability of any test results, logs, or analysis provided by the Service. You are solely responsible for reviewing and verifying all outputs before relying on them for production deployments or critical business decisions.
Ownership and Authorization Requirement: You represent and warrant that you own all rights, title, and interest in the web applications, APIs, and URLs you submit to the Service for testing, or that you have obtained explicit, documented legal authorization from the owner to conduct automated testing and scraping on their digital properties.
You agree NOT to use the Service to:
The Company reserves the right to immediately suspend or terminate your account, without notice or refund, if we determine, in our sole discretion, that you are utilizing the Service for unauthorized testing or malicious purposes. Furthermore, the Company will cooperate fully with law enforcement in the event of unauthorized cyber activities.
Company IP: Gumptious Enterprises, LLC retains all right, title, and interest in and to the Service, including all source code, algorithms, UI/UX designs, trademarks, and proprietary methodologies.
User Content:You retain all ownership rights to the URLs, application data, and prompt instructions you provide ("User Content"). By providing User Content, you grant the Company a worldwide, non-exclusive, royalty-free license to use, host, store, and process your User Content strictly for the purpose of providing, maintaining, and improving the Service.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. GUMPTIOUS ENTERPRISES, LLC EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT (I) THE SERVICE WILL MEET YOUR SPECIFIC REQUIREMENTS, (II) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, (III) THE RESULTS OR TESTS EXECUTED BY THE AI WILL BE ACCURATE OR RELIABLE, OR (IV) ANY ERRORS IN THE SERVICE WILL BE CORRECTED.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GUMPTIOUS ENTERPRISES, LLC, ITS DIRECTORS, EMPLOYEES, PARTNERS, OR AGENTS, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (III) ANY UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT; OR (IV) ANY SYSTEM FAILURES, DATA CORRUPTION, OR PRODUCTION OUTAGES CAUSED BY AUTOMATED TEST EXECUTIONS INITIATED BY THE SERVICE.
IN NO EVENT SHALL OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS ($100.00) OR THE AMOUNT YOU PAID US IN THE PAST TWELVE (12) MONTHS.
You agree to defend, indemnify, and hold harmless Gumptious Enterprises, LLC and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of: (i) your use and access of the Service, by you or any person using your account and password; (ii) a breach of these Terms, including the unauthorized testing of third-party applications; or (iii) any claim that your User Content caused damage to a third party.
These Terms shall be governed and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the state and federal courts located within Delaware to resolve any dispute or claim arising from these Terms.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any material changes by posting the updated Terms on this page. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.
